The bill amends Section 36-2103 of the Idaho Code regarding the definitions and exceptions for "outfitter" and "guide." It clarifies that private landowners and their employees, as well as individuals who rent or lease equipment to hunters or fishermen, are not classified as outfitters or guides under certain conditions. Specifically, the bill allows these individuals to accompany hunters on an incidental basis for the safety of livestock used in retrieving big game, without being considered outfitters or guides. Additionally, it introduces a new exception for public or private postsecondary educational institutions accredited by an organization recognized by the state board of education.
The bill also includes technical corrections and stipulates that individuals who obtain permission to outfit or guide on private property must be licensed unless their written agreement with the property owner states otherwise. An emergency clause is included, making the act effective on July 1, 2025.
