STATEMENT OF PURPOSE

This legislation ensures accountability to the laws passed by the legislature and receipt and expenditure of state
moneys by prohibiting the state from creating a corporation or acting as the incorporator of any corporation that
is not expressly authorized by the legislature through the enactment of general laws. It is not a violation for the
state to create or to authorize the creation of an independent public body politic and corporate that is created
in statute to carry out a public purpose, devoid of any private party with a right of control or management, or
which lacks any potential for private parties to change the fundamental structure or public purpose of the entity
as provided in the statute that created it.
FISCAL NOTE
This legislation causes no additional expenditure of funds and appropriately aligns the expenditure of moneys
of the state in furtherance of authorized purposes. Provided, there may be some administrative costs incurred
if a corporation is reformed as an independent public body politic and corporate or, if a nonprofit corporation,
to dissociate from the state of Idaho.
