STATEMENT OF PURPOSE

This legislation addresses the use of "deep fakes" generated by artificial intelligence and other digital technology
in electioneering. A candidate whose image, appearance or speech has been manipulated in an electioneering
communication using digital means so as to create a fundamentally different understanding or impression of
the appearance, action or speech than occurred in reality, the candidate may seek injunctive relief as well
as general and/or special damages. It shall be an affirmative defense that the electioneering communication
included sufficient disclosure that the video or audio representation was manipulated. This legislation further
aligns the electioneering periods for both primaries and general elections to 60 days before the election date.
FISCAL NOTE
This legislation causes no additional expenditure of funds at the state or local level of government nor does it
cause an increase or decrease in revenue for state or local government therefore the legislation had no fiscal
impact.
