STATEMENT OF PURPOSE

Excessive use fees and special assessments have been a tool that irrigation districts have used to provide proper
incentives to water users to follow their water rights and mitigation plans. Over time, the statutory limit of
$100 per acre foot of excess water use has lost effect due to inflation and increased commodity prices. This
legislation, requested by irrigation districts, brings that limit up to current times and provides a disincentive to
overuse of irrigation water.
FISCAL NOTE
This legislation causes no additional expenditure of funds at the state or local level of government nor does it
cause an increase or decrease in revenue for state government, however it may cause an increase in revenue for
a local irrigation district if water users exceed their allotment of water.
