STATEMENT OF PURPOSE

As the only governmental body vested with the constitutional power to make law in the State of Idaho, the
Legislature has a vital interest when the validity of an Idaho law is challenged. To this end, this legislation
amends the duties of the Attorney General to provide better alignment and coordination with the Legislature’s
role in cases under Section 67-465, Idaho Code.
FISCAL NOTE
Requiring certain consultations take place between the Attorney General and the President Pro Tempore of the
Senate and Speaker of the House of Representatives does not itself have any impact on any public funds. Such
consultations could result in increased or reduced legal costs for the State of Idaho, or no impact, depending
on the nature of the cases. These impacts, or lack thereof, cannot be predicted, as any costs, savings, or lack of
impact would vary from case to case.
