STATEMENT OF PURPOSE
RS30818 / H0432
Section 59-1316, Idaho Code, provides that member records are confidential but does not provide enforcement
mechanism in the event of disclosure of confidential information. In addition, it provides additional support in
quashing subpoena for confidential information, without a court ordered directive. The State tax commission
has this enforcement mechanism in code and uses it to enforce confidentiality and motions to quash.
FISCAL NOTE
This legislation will have no impact on the state’s General fund or any dedicated fund or federal fund because
it merely deals with penalties related to divulging information about someone’s private retirement information.
