STATEMENT OF PURPOSE

This legislation adds a section in the chapter of the Idaho Code relating to abortion. The legislation adds
definitions related to the illegal trafficking of minors to procure a criminal abortion and amends the section
of Idaho code dealing with criminal abortion by prohibiting anyone from trafficking a minor for a criminal
abortion with the intent of concealing the crime from the minor’s parents. This legislation authorizes the state
Attorney General to prosecute at their discretion for a crime committed under the section governing criminal
abortions. The legislation provides for civil remedies.
FISCAL NOTE
There should be no impact to the general fund. Should the State Attorney General’s office pursue prosecutions,
they are currently funded.
