STATEMENT OF PURPOSE

On June 27, 2022, the Supreme Court of the United States, in Kennedy v. Bremerton, overturned Lemon v.
Kurtzman, 403 U.S. 602 (1971). This ended over 50 years of stifling the First Amendment and our religious
freedoms. Though this was a Supreme Court decision, in order to make certain there was no question as to it's
application to the great State of Idaho, it was determined that Idaho would strengthen our state's standing with
a "belt & suspenders" approach. This bill protects our First Amendment right to freedom of religion and the
ability to exercise our individual expression without fear of repercussion at a public college, school district or
charter school.
FISCAL NOTE
Assuming that no rights are violated and no cause of action is required, there would be no impact to the General
Fund nor to any local government as this legislation centers on the protection of the free expression of our First
Amendment rights or our freedom of religion.
