STATEMENT OF PURPOSE

Idaho’s judges provide access to justice via fair processes and the timely, impartial resolution of the cases that
come before them. Unfortunately, these public servants and their families are experiencing increased threats
to their safety and security. As a result, this bill seeks to provide protection for judicial officers and their
family members by establishing a process to shield judges’ home addresses and telephone numbers from public
disclosure. Title 19, Chapter 58, Idaho Code sets forth a process to shield the home addresses and telephone
numbers of law enforcement officers, and this legislation mirrors this established process in order to afford
similar protections to judges. In addition, this bill recognizes the public is entitled to know elected officials
actually reside in the jurisdictions they serve. Specifically, since judges are elected officials, this legislation
requires that upon request a public agency must identify the county in which a judicial officer’s residential
street address is situated.
FISCAL NOTE
This proposed legislation will have no fiscal impact upon the General Fund, any other state fund, or local
governments. The bill expressly provides that a public agency may charge judges fees to cover the actual costs
to the agency, and thus, it will cause neither an increase nor a decrease in existing or future appropriations or
revenues.
