STATEMENT OF PURPOSE

The purpose of this legislation is to make several edits to the newly-established Office of Administrative
Hearings (OAH) unit. These changes include: establishing OAH a self-governing agency, making all
hearing officers and OAH employers non-classified state employees, adding a provision regarding the chief
administrative hearing officer, authorizing but not mandating the promulgation of rules, authorizing the chief
administrative officer to practice law that is otherwise permitted by a judge under Idaho Code of Judicial
Conduct, making adjustments to hearing officer qualifications, and making certain writings or work related to
decision making in any administrative proceeding exempt from public disclosure.
FISCAL NOTE
This legislation will have no impact on the state’s General fund or any dedicated fund or federal fund because
it merely makes non-budget related changes to the Office of Administrative Hearings Coordinator statute.
