STATEMENT OF PURPOSE

Adds a new section to Idaho Code 16-1648, Medical Kidnapping-Parental Rights. Protectng the rights of
parents pertaining to medical decisions regarding children as defined under the age of 18 and vulnerable adults
they are caring for.
The state of Idaho has the duty to protect due process and the presumption of innocence. Idaho Code 32-1011
Parental Right to the Care Custody and Control of Children. Parents have legal custody of any child or children
and have fundamental right to make decisions concerning their care, custody, and control.
FISCAL NOTE
There will be no fiscal to the State appropriations in this fiscal year upon enactment or in future fiscal years.
Because there is no requirement of action or appropriation by any state agency beyond change of Idaho Code.
There will be no fiscal impact to projected revenues for the State, in this fiscal year upon enactment or in future
fiscal years, beyond change of Idaho Code.
This legislation requires no code of action from the state other than regular implementation of change of Idaho
Code. There will be no requirements of enforcement, or other action necessary to be taken by State agencies
or local government agncies.
