STATEMENT OF PURPOSE

Idaho Code 40-616 prohibits County Commissioners and Highway District Commissioners from developing
sidewalks and side paths greater than eight (8) feet outside city limits. Local highway jurisdictions are receiving
numerous requests from members of the public, developers, bicycle and pedestrian advocacy groups to develop
uniform sidewalks and side paths to the same width outside city limits. Historically, local highway jurisdictions
have designed different width sidewalk and side path facilities for highway projects that are both within the City
and a county area of impact. The purpose of the legislation is to give local highway jurisdictions the authority
to develop uniform width sidewalks and side paths within a project and/or within a transportation corridor. In
doing so, the governing board of the local highway jurisdiction will have to make a written finding for the
public necessity of any sidewalk or side path that is greater than eight (8) feet.
FISCAL NOTE
This legislation would not place any requirements on local highway districts to expend funds in a particular
manner, and allows them an opportunity to choose a sidewalk or side path width that supports their needs,
within their budget. There is no fiscal impact to the general fund as a result of this legislation, since there is no
requirement for any state or local entity to act pursuant to the changes.
