This bill amends Section 80F.1 of the Iowa Code to enhance the rights of law enforcement officers regarding their placement on a Brady-Giglio list by a prosecuting agency. It establishes that any officer placed on such a list, regardless of when the decision was made, has the right to petition the district court for a review of that decision. The court is granted jurisdiction to conduct an in camera review of the evidence and may hold closed hearings if requested. The court can affirm, modify, or reverse the prosecuting agency's decision and may order the removal of the officer from the list if justice requires.
Additionally, if the court finds in favor of the officer, it is mandated to award equitable relief, reasonable attorney fees, expenses, and court costs, which will be covered by the state or the relevant municipality or county. The bill is effective immediately upon enactment and applies retroactively to any officer placed on a Brady-Giglio list and related proceedings occurring on or after July 1, 2021.
