This bill amends existing laws related to residential real estate, specifically focusing on the access to records of unit owners associations and the disclosure of home inspection information. It introduces a new requirement for unit owners associations to provide certification regarding the payment status of dues, fees, or assessments, indicating whether they are paid in full or delinquent, and to identify any known future dues, fees, or assessments. Additionally, it mandates that when a fee is charged for records, reasonable documentation must be provided to the unit owner or their authorized agent to ensure the fee does not exceed the actual cost of production.
Furthermore, the bill modifies the process for home inspection report disclosures. It removes the obligation for home inspectors to provide a copy of the inspection report to the seller upon request and instead requires the buyer or their authorized agent to provide relevant portions of the report that pertain to remediation requests. If the buyer or their agent fails to supply these portions, the seller is granted the right to cancel the purchase contract without penalty. This change aims to clarify the responsibilities of buyers and sellers in the home inspection process.
