The bill amends Iowa Code section 123.46A to remove the authorization for licensees to deliver alcoholic beverages to another licensed premises if there is identical ownership of the premises by the licensee. Instead, it introduces a new section, 123.46B, which allows licensees authorized to sell alcoholic liquor in original unopened containers for off-premises consumption to transfer alcoholic liquor between licensed premises that share identical ownership. This transfer is explicitly stated not to be considered a delivery under the previous section.

Additionally, the bill clarifies that the transferred alcoholic liquor will remain classified as inventory owned by the transferring licensee until it is placed on the premises of the receiving licensee. Once placed, the liquor will then be considered inventory of the receiving licensee for regulatory and enforcement purposes. Licensees conducting such transfers are required to maintain detailed records of the transfers for three years, which must be accessible for inspection by the department of revenue during normal business hours.
