This bill amends Code section 28E.30 to allow counties and cities to enter into agreements for the provision of law enforcement services by the county sheriff to the city. The agreement must specify the services provided and the relationship between the sheriff and the city officials. The sheriff can accept compensation not exceeding 105 percent of the actual costs incurred for these services, which must be itemized in the agreement. Additionally, if a city has contracted with the sheriff for law enforcement services, the sheriff is required to enforce city ordinances. The bill also permits multiple cities to collaborate on such agreements.
Furthermore, the bill mandates that cities with a police department and a population of 6,000 or less must submit a cost comparison report to the department of management by December 31, 2026, and annually thereafter. This report will compare the costs of maintaining their own police department versus contracting with another city or the county for law enforcement services. If the report indicates that contracting is more cost-effective, the city must present the proposal to voters in the next odd-numbered year election. If approved, the city will enter into an agreement for law enforcement services, which includes provisions for the transfer of current police department employees and equipment. The bill takes effect immediately upon enactment.
