The bill establishes a new legal framework allowing individuals residing in a school district to report potential violations of state law by the school board or superintendent to the county attorney. If a violation is identified, the county attorney is empowered to initiate a civil action against the board members who voted for the policy in question and the superintendent, aiming to ensure compliance with state law. Importantly, board members who did not support the policy cannot be named as defendants in such actions.
If the county attorney prevails in the civil action, the court is required to grant the requested injunctive relief and award the attorney either $1,000 for each defendant found to have adopted the violating policy or reimbursement for the costs incurred in the legal process, whichever is greater. The awarded funds are to be deposited into the county's general fund to support the county attorney's duties.
