This bill amends Section 321P.5 of the Iowa Code to prohibit local authorities that do not possess a valid permit for using automated or remote systems for traffic law enforcement from erecting or posting signs that indicate such systems are in use. The new subsection added specifies that a local authority found in violation of this prohibition will incur a civil penalty of $1,000 for each day the violation continues. The funds collected from these penalties will be directed to the road use tax fund.
Under current law, local authorities are required to hold a valid permit from the Department of Transportation (DOT) to utilize automated or remote traffic enforcement systems. If they do hold a permit, they must also post permanent signs notifying drivers of the system's presence. This bill strengthens enforcement by ensuring that only those with valid permits can inform the public about the use of these systems, thereby preventing unauthorized signage and associated confusion on the roadways.
