The Campus Due Process Act mandates the state board of regents to develop and adopt a comprehensive due process policy for faculty, staff, and students at regents institutions. This policy must guarantee constitutional rights of due process, with limited exceptions clearly justified in writing. It outlines specific due process protections, including the presumption of innocence, the right to counsel, access to evidence, and live hearings where both accusers and witnesses can be questioned. Additionally, the bill requires institutions to refer felony actions to local law enforcement and mandates that Title IX responsible employees have significant criminal defense experience.

Furthermore, the Act stipulates that institutions must implement disciplinary sanctions for individuals who interfere with the due process rights of others. Institutions are also required to inform students and employees about their due process protections and to make this information readily accessible on their websites. An annual report detailing violations of due process rights and the corresponding disciplinary actions must be submitted to the board and posted online. The provisions of this Act will take effect on December 31, 2026.
