This bill establishes a framework that allows residential property owners in Iowa to temporarily opt out of solid waste collection and disposal services provided by their county or city. To qualify for this opt-out, property owners must meet specific criteria, including being an eligible homestead receiving a homestead credit, submitting a completed application for an opt-out period not exceeding five consecutive months, and doing so at least eight weeks prior to the desired start date. The county or city is required to approve the application unless it is incorrectly filed or submitted late. During the opt-out period, any fees associated with solid waste services will be suspended.
Additionally, the bill outlines the process for submitting an application, which must include proof of ownership and other necessary information. An application fee of up to $5 per month for the requested opt-out period may be charged, and this fee will be refunded if the application is denied. Property owners are limited to one opt-out application per twelve-month period, and services will automatically resume at the end of the opt-out period unless an amended application is filed. The bill also imposes civil penalties for property owners who provide false information on their applications.
