This bill amends Section 455B.392 of the Iowa Code to expand the scope of strict liability for individuals or entities in control of hazardous substances. Specifically, it introduces a new subparagraph that holds these parties liable for the excessive and extraordinary costs incurred by the state or its political subdivisions, as well as their agents, for the oversight and monitoring of hazardous conditions caused by the person in control of the substance.

Under current law, strict liability already applies to certain costs associated with hazardous substances. However, this bill broadens that liability to include the additional financial burdens related to oversight and monitoring, thereby reinforcing accountability for those responsible for hazardous conditions. The intent is to ensure that the costs associated with managing hazardous situations are adequately addressed and that those responsible for creating such conditions bear the financial responsibility.
