This bill establishes regulations for commercial entities, referred to as "covered platforms," that publish or distribute obscene material on the internet. It defines key terms such as "covered platform," "identifying information," and "reasonable age verification." The bill mandates that covered platforms must perform reasonable age verification for individuals attempting to access obscene material, which can be conducted by third parties and may utilize cryptographic techniques to protect user privacy. Additionally, covered platforms and third parties are prohibited from retaining or disseminating individuals' identifying information obtained during the age verification process. Violations of these provisions can result in punitive damages, which cannot exceed three times the amount of reasonable attorney fees and costs.

The bill also grants the attorney general the authority to enforce compliance, including the ability to bring civil actions against covered platforms or third parties suspected of violations. Civil penalties for non-compliance can reach up to $10,000 per violation, with increased penalties of up to $100,000 for violations of injunctions. Furthermore, the bill clarifies that it does not impose liability on users of interactive computer services or providers merely for providing access to covered platforms or obscene material not under their control. An electronic reporting system will be established for individuals to report violations to the attorney general.
