This bill establishes a working group focused on nursing home Medicaid payment recovery, specifically addressing the discrepancies between nursing home residents who face Medicaid estate recovery after receiving care and nursing homes that do not undergo Medicaid payment recovery when they close or are sold. The working group will be convened by the Department of Health and Human Services and will include various members, such as the director of health and human services or their designee, the director of the Medicaid fraud control unit or their designee, individuals experienced in the Medicaid estate recovery process, and representatives from the General Assembly.
The working group is tasked with reviewing these issues and will provide administrative support from the Department of Health and Human Services, with the director or their designee serving as chairperson. A report with recommendations and proposed legislation aimed at ensuring public accountability following the closure or sale of nursing homes is to be submitted to the General Assembly by February 28, 2026. The working group will dissolve after submitting this report, but no later than March 1, 2026.
