This bill mandates that employees of the Iowa Department of Transportation (DOT) who are involved in accidents or collisions resulting in injury or death while operating a commercial motor vehicle must provide a urine specimen for alcohol and drug analysis. The specimen must be submitted to a peace officer as soon as practicable, but no later than two hours after the incident. The analysis will be conducted in accordance with existing laws related to operating while intoxicated (Code chapter 321J). Additionally, the employee has the option to request an independent analysis of the specimen at their own expense, although the inability to obtain this independent analysis does not affect the admissibility of the results from the official analysis.

The bill also clarifies that it does not apply if a blood, breath, or urine specimen is already taken under the provisions of Code chapter 321J. Violations of this requirement are classified as simple misdemeanors, which carry penalties of up to 30 days of confinement and fines ranging from $105 to $855.
