This bill amends Section 123.46 of the Iowa Code to allow for the sale, possession, and consumption of alcoholic liquor, wine, or beer on public school property under specific conditions. It stipulates that a school board may authorize these activities in conjunction with a nonschool-related function deemed appropriate by the board, provided that the sale occurs on premises covered by a five-day retail alcohol license issued to a person other than the school board. The bill also maintains that individuals are prohibited from possessing or consuming alcoholic beverages on public school property during school-related functions.
Additionally, the bill includes several insertions and deletions to clarify the regulations surrounding alcohol consumption in public places. It specifies that individuals cannot use or consume alcoholic beverages on public streets or highways, nor in any public place except licensed premises. The bill also establishes that violations of these provisions are classified as simple misdemeanors, punishable by confinement for up to 30 days and fines ranging from $105 to $855. The bill is set to take effect immediately upon enactment.
