This bill establishes new regulations regarding the recovery of overpayments made by dental carriers to dental care providers. It requires dental carriers to create written policies and procedures that allow providers to appeal overpayment recovery requests within a minimum of 90 calendar days after receiving notice of the overpayment. The bill defines "overpayment" as an erroneous payment made by a dental carrier for dental care services and mandates that carriers notify providers of the overpayment within 365 calendar days, detailing the error and the recovery request.
Additionally, the bill allows dental carriers to recover overpayments by withholding or reducing payments for different claims, provided they notify the provider within 28 calendar days of such action. Importantly, the bill stipulates that the requirements cannot be waived by contract, rendering any conflicting agreements null and void. The commissioner of insurance is also granted the authority to adopt rules to administer these provisions.
