Senate File 473 amends Iowa's adoption laws to protect the rights of individual licensees and approved kinship caregivers regarding their sincerely held religious or moral beliefs related to sexual orientation and gender identity. The bill prohibits the Department of Health and Human Services from requiring these caregivers to affirm or support policies that conflict with their beliefs and ensures that such beliefs cannot be used as a basis for disqualifying them from being licensed or approved. Additionally, the bill allows current or prospective caregivers to take legal action if they believe their rights under this subsection have been violated, with the possibility of receiving injunctive relief and attorney fees.

Furthermore, the bill establishes that if adoption services are provided by the department, the primary criterion for selecting adoptive parents should be the stability of the home environment. It also ensures that prospective adoptive parents cannot be disqualified based on their religious or moral beliefs related to sexual orientation or gender identity. The department is required to consider the beliefs of both the child and their family of origin when determining the most appropriate placement for the child. Lastly, the bill allows religious organizations contracted with the department to provide services in a manner consistent with their beliefs, while still maintaining the department's obligation to prioritize the best interests of the child.
