This bill amends the existing law regarding court-ordered substance use disorder evaluations for individuals convicted of operating while intoxicated. Under current law, individuals must undergo and pay for a substance use disorder evaluation prior to sentencing. The proposed changes remove the requirement for the evaluation to take place before sentencing, allowing for more flexibility in the timing of the evaluation.

As a result of this amendment, the court will still order individuals to follow the recommendations from the substance use disorder evaluation, but the evaluation itself can occur after sentencing rather than being a prerequisite. This change aims to streamline the process and potentially reduce the burden on individuals awaiting sentencing.
