This bill amends existing laws regarding the time limits for bringing civil actions related to sexual abuse and other sexual offenses that occurred when the victim was a minor. It establishes a distinction between victims who were minors at the time of the abuse and those who were 18 years or older. For minors, the bill allows actions to be brought within ten years from the time of discovery of the injury or the relationship between the injury and the abuse, or within ten years from the attainment of majority, whichever is later. Additionally, it revives claims that were previously barred due to expired limitations, allowing them to be filed within three years of the bill's effective date.
The bill also introduces a preference in trial order for certain cases, specifically those revived under the new provisions or those deemed by the supreme court to serve the interests of justice for early trial. The district court is required to try civil cases in the order they are filed, but cases entitled to preference will be prioritized. The bill takes effect immediately upon enactment, ensuring that victims have timely access to justice and the opportunity to pursue their claims.
