This bill amends Section 364.3 of the Code 2025 to establish new regulations regarding vegetation planted by landowners in residential areas. Specifically, it prohibits cities from adopting or enforcing any ordinances, motions, resolutions, or amendments that would restrict property owners in residentially zoned districts with a speed limit of 25 miles per hour or less from growing purposely planted vegetation that is 42 inches or less in height.
Additionally, for vegetation located along the curb line that could obstruct a motorist's view, the height restriction is set at 34 inches or less. This legislation aims to protect the rights of property owners to cultivate their land while ensuring that public safety is not compromised by excessive vegetation height.
