The bill amends Section 709.21 of the Iowa Code to expand the definition of invasion of privacy. Under the current law, a person is guilty of invasion of privacy if they knowingly view, photograph, or film another person without consent for the purpose of sexual arousal, provided the other person is in a state of nudity and has a reasonable expectation of privacy. The new language adds that a person who knowingly possesses such photographs or films is also guilty of invasion of privacy.
As a result of this amendment, the penalties for invasion of privacy remain the same, classified as an aggravated misdemeanor and a tier II sex offense. Individuals convicted under this section will still be required to register as sex offenders for a period of 10 years. This change aims to strengthen protections against the non-consensual sharing and possession of intimate images.
