The bill defines DEI efforts broadly, including any attempts to influence employee or student body composition based on race, sex, or ethnicity, as well as promoting policies or training related to these concepts. However, it clarifies that funding for academic instruction, research, student organization activities, and certain health services is not affected by this prohibition.
Additionally, the bill allows for enforcement by the attorney general, who can take action against state entities for violations, and provides a private cause of action for students, alumni, or employees of state entities to seek injunctive relief. The bill specifies the venues where such actions can be brought and states that it will take effect immediately upon enactment.
