This bill establishes a new section regarding Medicare supplement insurance, specifically introducing an annual open enrollment period for applicants. Starting January 1, 2026, applicants will have a thirty-one-day open enrollment period that begins on March 1. The bill defines "applicant" as an individual covered under a Medicare supplement policy, including those under sixty-five who qualify for Medicare due to disability or other specific conditions. It also provides a definition for "Medicare supplement policy" and "issuer," which includes various entities that deliver or issue Medicare supplement policies.
During the open enrollment period, issuers are prohibited from denying or conditioning the issuance of Medicare supplement policies, subjecting applicants to medical underwriting, or discriminating in pricing based on health status or medical conditions. Additionally, they cannot impose exclusions based on preexisting conditions. Issuers are required to notify applicants of the open enrollment period in a manner prescribed by the commissioner of insurance.
