The bill establishes a new legal framework for civil actions against school board members and superintendents in Iowa when school policies are believed to violate state law. It allows any resident of a school district to notify the county attorney of a potential violation, enabling the attorney to initiate a civil action against the board members who voted for the policy and the superintendent. Importantly, members who did not support the policy in question cannot be named as defendants.
If the county attorney prevails in the civil action, the court is required to grant the requested injunctive relief and award the attorney either $1,000 for each defendant found to have adopted the violating policy or the costs incurred in bringing the action, whichever is greater. The awarded funds must be deposited into the county's general fund to support the county attorney's duties. This bill aims to enhance accountability among school officials regarding compliance with state laws.
