This bill establishes a new section regarding Medicare supplement insurance, specifically introducing an annual open enrollment period for applicants beginning January 1, 2026. The open enrollment period lasts for thirty days and starts on the applicant's birthday. The bill defines "applicant" as individuals aged sixty-five and older seeking Medicare supplement benefits, as well as those under sixty-five who qualify for Medicare due to disability or other specific conditions. It also provides a definition for "Medicare supplement policy."
During the open enrollment period, issuers of Medicare supplement policies are prohibited from denying coverage, subjecting applicants to medical underwriting, or discriminating based on health status or preexisting conditions. Applicants can select a policy with the same or lesser benefits than their current coverage. Additionally, issuers are required to notify applicants about the open enrollment period when they apply for a Medicare supplement policy or certificate.
