AN ACT
RELATING TO AND MAKING APPROPRIATIONS FROM THE REBUILD IOWA
INFRASTRUCTURE FUND AND TECHNOLOGY REINVESTMENT FUND,
PROVIDING FOR RELATED MATTERS INCLUDING RENEWABLE FUEL
INFRASTRUCTURE INCENTIVES, AND INCLUDING EFFECTIVE DATE
PROVISIONS.
6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 DIVISION I
2 REBUILD IOWA INFRASTRUCTURE FUND
3 Section 1. REBUILD IOWA INFRASTRUCTURE FUND ——
4 APPROPRIATIONS. There is appropriated from the rebuild Iowa
5 infrastructure fund created in section 8.57 to the following
6 departments and agencies for the following fiscal years, the
7 following amounts, or so much thereof as is necessary, to be
8 used for the purposes designated:
9 1. DEPARTMENT OF ADMINISTRATIVE SERVICES
10 a. For major maintenance projects:

23 Of the amount appropriated in this paragraph, the department
24 of administrative services shall allocate and use the moneys
25 necessary to improve and repair the steps on the west side
26 of the exterior of the capitol building, as directed by the
27 legislative branch, by the close of the fiscal year that begins
28 July 1, 2024.
29 c. For elevator upgrades and replacement on the capitol
30 complex and Terrace Hill:

33 2. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
34 a. (1) For deposit in the water quality initiative fund
35 created in section 466B.45 for purposes of supporting the
1 water quality initiative administered by the division of soil
2 conservation and water quality as provided in section 466B.42,
3 including salaries, support, maintenance, and miscellaneous
4 purposes, notwithstanding section 8.57, subsection 5, paragraph
5 “c”:
6 FY 2024-2025:

8 (2) (a) The moneys appropriated in this lettered
9 paragraph shall be used to support demonstration projects in
10 subwatersheds as designated by the department that are part
11 of high-priority watersheds identified by the water resources
12 coordinating council.
13 (b) The moneys appropriated in this lettered paragraph
14 shall be used to support demonstration projects in watersheds

15 generally, including regional watersheds, as designated by the
16 division and high-priority watersheds identified by the water
17 resources coordinating council.
18 (3) In supporting projects in watersheds and subwatersheds
19 as provided in subparagraph (2), all of the following apply:
20 (a) The demonstration projects must utilize water quality
21 practices as described in the latest revision of the document
22 entitled “Iowa Nutrient Reduction Strategy” initially presented
23 in November 2012 by the department of agriculture and land
24 stewardship, the department of natural resources, and Iowa
25 state university of science and technology.
26 (b) The division shall implement demonstration projects
27 as provided in subparagraph division (a) by providing
28 for participation by persons who hold a legal interest in
29 agricultural land used in farming. To every extent practical,
30 the division shall provide for collaborative participation by
31 such persons who hold a legal interest in agricultural land
32 located within the same subwatershed.
33 (c) The division shall implement demonstration projects on
34 a cost-share basis as determined by the division. Except for
35 edge-of-field practices, the state’s share of the amount shall
1 not exceed 50 percent of the estimated cost of establishing the
2 practice as determined by the division or 50 percent of the
3 actual cost of establishing the practice, whichever is less.
4 (d) The demonstration projects shall be used to educate
5 other persons about the feasibility and value of establishing
6 similar water quality practices. The division shall promote
7 field day events for purposes of allowing interested persons to
8 establish water quality practices on such persons’ agricultural
9 land.
10 (e) The division shall conduct water quality evaluations
11 within supported subwatersheds. Within a reasonable period
12 after accumulating information from such evaluations, the
13 division shall create an aggregated database of water quality
14 practices. Any information identifying a person holding a
15 legal interest in agricultural land or specific agricultural
16 land shall be a confidential record.
17 (4) The moneys appropriated in this lettered paragraph
18 shall be used to support education and outreach in a manner

19 that encourages persons who hold a legal interest in
20 agricultural land used for farming to implement water quality
21 practices, including the establishment of such practices in
22 watersheds generally, and not limited to subwatersheds or
23 high-priority watersheds.
24 (5) The moneys appropriated in this lettered paragraph
25 may be used to contract with persons to coordinate the
26 implementation of efforts provided in this lettered paragraph.
27 (6) The moneys appropriated in this lettered paragraph
28 may be used by the department to support urban soil and water
29 conservation efforts, which may include but are not limited
30 to management practices related to bioretention, landscaping,
31 the use of permeable or pervious pavement, and soil quality
32 restoration. The moneys shall be allocated on a cost-share
33 basis as provided in chapter 161A.
34 (7) Notwithstanding any other provision of law to the
35 contrary, the department may use moneys appropriated in
1 this lettered paragraph to carry out the provisions of this
2 paragraph on a cost-share basis in combination with other
3 moneys available to the department from a state or federal
4 source.
5 (8) Not more than 10 percent of the moneys appropriated in
6 this lettered paragraph may be used for costs of administration
7 and implementation of the water quality initiative administered
8 by the soil conservation division.
9 b. For deposit in the renewable fuel infrastructure fund
10 created in section 159A.16 for renewable fuel infrastructure
11 programs:

14 The appropriation made in this paragraph is in lieu of the
15 standing appropriation from the general fund of the state in
16 section 159A.17 for the fiscal year beginning July 1, 2024, and
17 ending June 30, 2025, which shall be zero.

19 created in section 159A.16 for renewable fuel infrastructure
20 programs:

35 of this paragraph is a confidential record exempt from public
1 release if the information identifies a person who holds a
2 legal interest in agricultural land or who has previously held

5 land or producing crops or livestock on the agricultural land,
6 or the identifiable location of the agricultural land.
