AN ACT
RELATING TO AND MAKING APPROPRIATIONS INVOLVING STATE
GOVERNMENT ENTITIES ASSOCIATED WITH AGRICULTURE, NATURAL
RESOURCES, AND ENVIRONMENTAL PROTECTION, AND INCLUDING
EFFECTIVE DATE PROVISIONS.
5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 DIVISION I
2 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
3 GENERAL FUND APPROPRIATIONS
4 Section 1. GENERAL FUND —— DEPARTMENT.
5 1. There is appropriated from the general fund of the state
6 to the department of agriculture and land stewardship for the
7 fiscal year beginning July 1, 2024, and ending June 30, 2025,
8 the following amount, or so much thereof as is necessary, to be
9 used for the purposes designated:
10 For purposes of supporting the department, including its
11 divisions, for administration, regulation, and programs; for
12 salaries, support, maintenance, and miscellaneous purposes; and
13 for not more than the following full-time equivalent positions:

16 2. Of the amount appropriated in subsection 1, the following
17 amount is transferred to Iowa state university of science and
18 technology, to be used for the university’s midwest grape and
19 wine industry institute:

21 3. The department shall submit a report each quarter of
22 the fiscal year to the general assembly and the department
23 of management. The report shall describe in detail the
24 expenditure of moneys appropriated in this section to support
25 the department’s administration, regulation, and programs.
26 DESIGNATED APPROPRIATIONS FROM MISCELLANEOUS FUNDS
27 Sec. 2. UNCLAIMED PARI-MUTUEL WAGERING WINNINGS ——
28 HORSE AND DOG RACING. There is appropriated from the moneys
29 available under section 99D.13 to the department of agriculture
30 and land stewardship for the fiscal year beginning July 1,
31 2024, and ending June 30, 2025, the following amount, or so
32 much thereof as is necessary, to be used for the purposes
33 designated:
34 For purposes of supporting the department’s administration
35 and enforcement of horse and dog racing law pursuant to section
1 99D.22, including for salaries, support, maintenance, and
2 miscellaneous purposes:

4 Sec. 3. RENEWABLE FUEL INFRASTRUCTURE FUND —— MOTOR
5 FUEL INSPECTION. There is appropriated from the renewable
6 fuel infrastructure fund created in section 159A.16 to the
7 department of agriculture and land stewardship for the fiscal
8 year beginning July 1, 2024, and ending June 30, 2025, the
9 following amount, or so much thereof as is necessary, to be
10 used for the purposes designated:
11 For purposes of the inspection of motor fuel, including
12 salaries, support, maintenance, and miscellaneous purposes:
13 .................................................. $ 500,000
14 SPECIAL GENERAL FUND APPROPRIATIONS
15 Sec. 4. SPECIAL APPROPRIATIONS FROM GENERAL FUND TO
16 DEPARTMENT. There is appropriated from the general fund of the
17 state to the department of agriculture and land stewardship
18 for the fiscal year beginning July 1, 2024, and ending June
19 30, 2025, the following amounts, or so much thereof as is
20 necessary, to be used for the purposes designated:
21 1. DAIRY REGULATION
22 a. For purposes of performing functions pursuant to section
23 192.109, including conducting a survey of grade “A” milk and
24 certifying the results to the secretary of agriculture:

26 b. Notwithstanding section 8.33, moneys appropriated in
27 this subsection that remain unencumbered or unobligated at the
28 close of the fiscal year shall not revert but shall remain
29 available for expenditure for the purposes designated until the
30 close of the succeeding fiscal year.
31 2. LOCAL FOOD AND FARM PROGRAM
32 a. For purposes of supporting the local food and farm
33 program pursuant to chapter 267A:
34 .................................................. $ 75,000
35 b. The department shall enter into a cost-sharing agreement
1 with Iowa state university of science and technology to support
2 the local food and farm program coordinator position as part of
3 the university’s cooperative extension service in agriculture
4 and home economics pursuant to chapter 267A.
5 c. Notwithstanding section 8.33, moneys appropriated in
6 this subsection that remain unencumbered or unobligated at the
7 close of the fiscal year shall not revert but shall remain
8 available for expenditure for the purposes designated until the
9 close of the succeeding fiscal year.
10 3. AGRICULTURAL EDUCATION
11 a. For purposes of allocating moneys to an Iowa association
12 affiliated with a national organization that promotes
13 agricultural education providing for future farmers:
14 .................................................. $ 150,000
15 b. Notwithstanding section 8.33, moneys appropriated in
16 this subsection that remain unencumbered or unobligated at the
17 close of the fiscal year shall not revert but shall remain
18 available for expenditure for the purposes designated until the
19 close of the succeeding fiscal year.
20 4. FOREIGN ANIMAL DISEASES AFFLICTING LIVESTOCK
21 a. For deposit in the foreign animal disease preparedness
22 and response fund created in section 163.3B to further
23 implement a foreign animal disease preparedness and response
24 strategy as described in section 163.3C:
25 .................................................. $ 1,050,000
26 b. For deposit in the foreign animal disease preparedness
27 and response fund created in section 163.3B, for purposes
28 of purchasing and maintaining equipment to further the

29 implementation of the foreign animal disease preparedness and
30 response strategy developed under section 163.3C:
31 .................................................. $ 250,000
32 5. FARMERS WITH DISABILITIES PROGRAM
33 a. For purposes of supporting a program for farmers with
34 disabilities:
35 .................................................. $ 230,000
1 b. The moneys appropriated in this subsection shall be
2 used for the public purpose of providing a grant to a national
3 nonprofit organization with over 80 years of experience in
4 assisting children and adults with disabilities and special
5 needs. The moneys shall be used to support a nationally
6 recognized program that began in 1986 and has been replicated
7 in at least 30 other states, but is not available through
8 any other entity in this state, and that provides assistance
9 to farmers with disabilities in all 99 counties to allow the
10 farmers to remain in their own homes and be gainfully engaged
11 in farming through provision of agricultural worksite and home
12 modification consultations, peer support services, services
13 to families, information and referral, and equipment loan
14 services.
15 c. Notwithstanding section 8.33, moneys appropriated in
16 this subsection that remain unencumbered or unobligated at the
17 close of the fiscal year shall not revert but shall remain
18 available for expenditure for the purposes designated until the
19 close of the succeeding fiscal year.
20 6. LOESS HILLS DEVELOPMENT AND CONSERVATION FUND
21 a. For deposit in the loess hills development and
22 conservation fund created pursuant to section 161D.2:
23 .................................................. $ 400,000
24 b. (1) Of the amount appropriated to the loess hills
25 development and conservation fund in this subsection, $360,000
26 shall be allocated to the fund’s hungry canyons account.
27 (2) Not more than 10 percent of the moneys allocated to the
28 fund’s hungry canyons account as provided in this paragraph may
29 be used for administrative costs.
30 c. (1) Of the amount appropriated to the loess hills
31 development and conservation fund in this subsection, $40,000
32 shall be allocated to the fund’s loess hills alliance account.

33 (2) Not more than 10 percent of the moneys allocated to
34 the fund’s loess hills alliance account as provided in this
35 paragraph may be used for administrative costs.
1 7. SOUTHERN IOWA DEVELOPMENT AND CONSERVATION FUND
2 a. For deposit in the southern Iowa development and
3 conservation fund created pursuant to section 161D.12:
4 .................................................. $ 200,000
5 b. Not more than 10 percent of the moneys appropriated
6 to the fund as provided in this subsection may be used for
7 administrative costs.
8 8. GRAIN REGULATION
9 For the administration and enforcement of chapters 203
10 and 203C, including salaries, support, maintenance, and
11 miscellaneous purposes:
12 .................................................. $ 350,000
13 Sec. 5. CHOOSE IOWA FOOD PURCHASING PILOT PROJECT FOR
14 SCHOOLS AND SCHOOL DISTRICTS OR FOOD BANKS AND IOWA EMERGENCY
15 FEEDING ORGANIZATIONS.
16 1. There is appropriated from the general fund of the state
17 to the department of agriculture and land stewardship for the
18 fiscal year beginning July 1, 2024, and ending June 30, 2025,
19 the following amount, or so much thereof as is necessary, to be
20 used for the purposes designated:
21 For purposes of supporting a choose Iowa food purchasing
22 pilot project to assist eligible participants in purchasing
23 qualified food products:
24 .................................................. $ 200,000
25 2. Except as provided in subsection 3, the department
26 shall administer the pilot project based on the farm-to-school
27 program described in chapter 190A, in which the department
28 reimburses a school or school district for the purchase of a
29 food product originating from a farm source.
30 3. The department shall administer the pilot project
31 according to all of the following:
32 a. A farm or business that owns or operates the farm
33 source shall be given a preference to participate in the pilot
34 project if the farm or business is currently participating in
35 the choose Iowa promotional program as provided in chapter
1 159, subchapter II, part 2, Code 2024. Otherwise, a farm

2 or business may participate in the pilot project if the farm
3 or business has applied to participate in the choose Iowa
4 promotional program and the department determines that the
5 application will be approved.
6 b. An eligible participant is limited to any of the
7 following:
8 (1) A public or private school or a school district, if the
9 public or private school or school district is not currently
10 participating in the farm-to-school program.
11 (2) An Iowa food bank or an Iowa emergency feeding
12 organization, recognized by the department.
13 c. A qualified food product is limited to the following:
14 (1) For a school or school district, meat and poultry, dairy
15 products other than milk, eggs, honey, and produce.
16 (2) For an Iowa food bank or Iowa emergency feeding
17 organization, meat and poultry, dairy products, eggs, honey,
18 and produce.
19 d. The department is not required to follow a requirement in
20 chapter 190A that the department determines is not practical
21 for the pilot project.
22 4. a. Of the moneys appropriated in subsection 1, not more
23 than $100,000 shall be used to reimburse schools or school
24 districts and not more than $150,000 shall be used to reimburse
25 Iowa food banks and Iowa emergency feeding organizations.
26 b. An eligible participant shall be reimbursed on a matching
27 basis with the department contributing $1 for every $1 expended
28 by the eligible participant.
29 c. (1) A school or school district shall not receive more
30 than $1,000 for participating in the pilot project.
31 (2) An Iowa food bank or Iowa emergency feeding organization
32 shall not receive more than $25,000 for participating in the
33 pilot project.
34 5. The department may use not more than 5 percent of the
35 moneys appropriated in subsection 1 to pay for the costs of
1 administering the pilot project.
2 6. Notwithstanding section 8.33, moneys appropriated in
3 subsection 1 for the fiscal year beginning July 1, 2024,
4 that remain unencumbered or unobligated at the close of the
5 fiscal year shall not revert but shall remain available for

6 expenditure for the purposes designated in subsection 1 until
7 the close of the fiscal year beginning July 1, 2026.
8 7. The department shall prepare and submit a report
9 regarding its findings and recommendations to the governor and
10 general assembly not later than January 15, 2025.
11 DIVISION II
12 DEPARTMENT OF NATURAL RESOURCES
13 Sec. 6. GENERAL FUND —— DEPARTMENT.
14 1. There is appropriated from the general fund of the state
15 to the department of natural resources for the fiscal year
16 beginning July 1, 2024, and ending June 30, 2025, the following
17 amount, or so much thereof as is necessary, to be used for the
18 purposes designated:
19 For purposes of supporting the department, including its
20 divisions, for administration, regulation, and programs; for
21 salaries, support, maintenance, and miscellaneous purposes; and
22 for not more than the following full-time equivalent positions:
23 .................................................. $ 12,500,000
24 ............................................... FTEs 1,145.95
25 2. Of the number of full-time equivalent positions
26 authorized to the department pursuant to subsection 1, 50.00
27 full-time equivalent positions shall be allocated by the
28 department for seasonal employees for purposes of providing
29 maintenance, upkeep, and sanitary services at state parks.
30 This subsection shall not impact conservation officer, park
31 ranger, or park manager positions within the department.
32 3. The department shall submit a report each quarter of
33 the fiscal year to the general assembly and the department
34 of management. The report shall describe in detail the
35 expenditure of moneys appropriated under this section to
1 support the department’s administration, regulation, and
2 programs.
3 Sec. 7. STATE FISH AND GAME PROTECTION FUND —— REGULATION
4 AND ADVANCEMENT OF OUTDOOR ACTIVITIES.
5 1. There is appropriated from the state fish and game
6 protection fund created pursuant to section 456A.17 to the
7 department of natural resources for the fiscal year beginning
8 July 1, 2024, and ending June 30, 2025, the following amount,
9 or so much thereof as is necessary, to be used for the purposes

10 designated:
11 For purposes of supporting the regulation or advancement of
12 hunting, fishing, or trapping, or the protection, propagation,
13 restoration, management, or harvest of fish or wildlife,
14 including for administration, regulation, law enforcement, and
15 programs; and for salaries, support, maintenance, equipment,
16 and miscellaneous purposes:
17 .................................................. $ 49,752,093
18 2. Notwithstanding section 455A.10, the department may use
19 the unappropriated balance remaining in the state fish and game
20 protection fund to provide for the funding of health and life
21 insurance premium payments from unused sick leave balances of
22 conservation peace officers employed in a protection occupation
23 who retire, pursuant to section 97B.49B.
24 3. Notwithstanding section 455A.10, the department may
25 use the unappropriated balance remaining in the state fish
26 and game protection fund for the fiscal year beginning July
27 1, 2024, and ending June 30, 2025, as is necessary to fund
28 salary adjustments for departmental employees for which the
29 general assembly has made an operating budget appropriation in
30 subsection 1.
31 Sec. 8. GROUNDWATER PROTECTION FUND —— WATER QUALITY. There
32 is appropriated from the groundwater protection fund created
33 in section 455E.11 to the department of natural resources for
34 the fiscal year beginning July 1, 2024, and ending June 30,
35 2025, from those moneys that are not allocated pursuant to
1 that section, the following amount, or so much thereof as is
2 necessary, to be used for the purposes designated:
3 For purposes of supporting the department’s protection
4 of the state’s groundwater, including for administration,
5 regulation, and programs, and for salaries, support,
6 maintenance, equipment, and miscellaneous purposes:
