1 An Act requiring public schools to provide diabetes information
2 to students’ parents and guardians.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 256.9, Code 2024, is amended by adding
2 the following new subsection:
3 NEW SUBSECTION. 36. a. Develop, in coordination with the
4 department of health and human services and any other entity
5 the director deems appropriate, informational materials related
6 to type one diabetes. The informational materials shall
7 include all of the following:
8 (1) A description of type one diabetes.
9 (2) A description of the risk factors and warning signs
10 associated with type one diabetes.
11 (3) A recommendation related to the warning signs
12 associated with type one diabetes that should cause the parent
13 or guardian of a student displaying such warning signs to
14 immediately consult with the student’s primary care provider
15 to determine if an immediate screening for type one diabetes
16 is appropriate.
17 (4) A description of the screening process for type one
18 diabetes and the implications of test results.
19 (5) A recommendation that, following a student’s type one
20 diabetes diagnosis, the student’s parent or guardian should
21 consult with the student’s primary care provider to develop
22 an appropriate treatment plan, which may include consultation
23 with and examination by a specialty care provider, including a
24 qualified endocrinologist.
25 b. Distribute the informational materials developed under
26 paragraph “a” to all of the following:
27 (1) School districts.
28 (2) Charter schools established pursuant to chapter 256E or
29 256F.
30 (3) Innovation zone schools established pursuant to chapter
31 256F.
32 c. Publish the informational materials developed under
33 paragraph “a” on the department’s internet site.
34 Sec. 2. Section 256E.7, subsection 2, Code 2024, is amended
35 by adding the following new paragraph:

1 NEW PARAGRAPH. 0r. Be subject to and comply with the
2 requirements of section 279.84 relating to the provision of
3 informational materials related to type one diabetes developed
4 by the director of the department of education in the same
5 manner as a school district.
6 Sec. 3. Section 256F.4, subsection 2, Code 2024, is amended
7 by adding the following new paragraph:
8 NEW PARAGRAPH. p. Be subject to and comply with the
9 requirements of section 279.84 relating to the provision of
10 informational materials related to type one diabetes developed
11 by the director of the department of education in the same
12 manner as a school district.
13 Sec. 4. NEW SECTION. 279.84 Type one diabetes informational
14 materials.
15 Each school district shall provide the parent or guardian of
16 each student who enrolls in the school district for the first
17 time in grades one through six with copies of the informational
18 materials related to type one diabetes developed by the
19 director of the department of education pursuant to section
20 256.9, subsection 36, or with a link to the department’s
21 internet site where such informational materials are published.
22 Sec. 5. STATE MANDATE FUNDING SPECIFIED. In accordance
23 with section 25B.2, subsection 3, the state cost of requiring
24 compliance with any state mandate included in this Act shall be
25 paid by a school district or charter school from state school
26 foundation aid received by the school district under section
27 257.16 or by a charter school from moneys received by the
28 charter school under section 256E.8. This specification of the
29 payment of the state cost shall be deemed to meet all of the
30 state funding-related requirements of section 25B.2, subsection
31 3, and no additional state funding shall be necessary for the
32 full implementation of this Act by and enforcement of this Act
33 against all affected school districts and charter schools.

1 the explanation’s substance by the members of the general assembly.
2 This bill requires public schools to provide diabetes
3 information to students’ parents and guardians.
4 The bill requires the director of the department of
5 education to develop, in coordination with the department of
6 health and human services and any other entity the director
7 deems appropriate, informational materials related to type
8 one diabetes. The bill establishes what the informational
9 materials are required to include. The bill requires the
10 director to distribute the informational materials to school
11 districts, charter schools, and innovation zone schools. The
12 bill also requires the director to publish the informational
13 materials on the department’s internet site.
14 The bill requires school districts, charter schools, and
15 innovation zone schools to provide the parent or guardian of
16 each student who enrolls in the school for the first time
17 in grades one through six with copies of the informational
18 materials or with a link to the department of education’s
19 internet site where such informational materials are published.
20 The bill may include a state mandate as defined in Code
21 section 25B.3. The bill requires that the state cost of any
22 state mandate included in the bill be paid by a school district
23 from state school foundation aid received by the school
24 district under Code section 257.16 or by the charter school
25 from moneys received by the charter school under Code section
26 256E.8. The specification is deemed to constitute state
27 compliance with any state mandate funding-related requirements
28 of Code section 25B.2. The inclusion of this specification is
29 intended to reinstate the requirement of political subdivisions
30 to comply with any state mandates included in the bill.
