SENATE RESOLUTION NO. 104
BY WHITVER, DAWSON, ZAUN, REICHMAN, SINCLAIR,
KRAAYENBRINK, ZUMBACH, BROWN, COSTELLO, DRISCOLL,
LOFGREN, SCHULTZ, McCLINTOCK, GREEN, KLIMESH,
GUTH, ALONS, BOUSSELOT, DE WITT, KOELKER, WESTRICH,
J. TAYLOR, SWEENEY, GRUENHAGEN, DICKEY, SALMON,
COURNOYER, EVANS, GARRETT, EDLER, WEBSTER,
ROZENBOOM, SHIPLEY, and ROWLEY
1 A Resolution supporting increased protections for
2 America’s borders.
3 WHEREAS, on January 20, 2021, President Biden
4 terminated the national emergency at the southern
5 border declared by Presidential Proclamation 9844
6 and halted the funding and construction of the border
7 wall; and
8 WHEREAS, within Presidential Proclamation 10142,
9 President Biden described the construction of the
10 wall as “a waste of money that diverts attention from
11 genuine threats to our homeland security” and declared
12 that the national emergency at the southern border “was
13 unwarranted”; and
14 WHEREAS, despite President Biden’s subsequent
15 legislative efforts to ostensibly modernize the
16 immigration system and secure the border against
17 criminal activity, the United States Customs and Border
18 Protection reports that illicit fentanyl smuggling is
19 increasing across the southern border; and
20 WHEREAS, the amount of fentanyl seized by the United
21 States Customs and Border Protection has increased by
22 860 percent since fiscal year 2019, representing a

1 staggering 27,000 pounds recovered in fiscal year 2023
2 compared to just 2,545 pounds in fiscal year 2019; and
3 WHEREAS, as written by the state of Texas Governor
4 Greg Abbott on January 24, 2024, President Biden “has
5 violated his oath to faithfully execute immigration
6 laws enacted by Congress”, “instructed his agencies to
7 ignore federal statutes that mandate the detention of
8 illegal immigrants”, and “inflicted unprecedented harm
9 on the People all across the United States”; and
10 WHEREAS, the state of Texas has declared that an
11 invasion has occurred under the meaning of Article I,
12 section 10, clause 3, of the Constitution of the United
13 States and has invoked its constitutional authority to
14 defend and protect itself, leading the state of Texas
15 to launch Operation Lone Star; and
16 WHEREAS, Operation Lone Star has led to more
17 than 501,300 illegal immigrant apprehensions,
18 39,800 criminal arrests, and 35,800 felony charges,
19 successfully filling the dangerous gaps created by
20 the Biden administration’s refusal to secure the
21 border; and
22 WHEREAS, under circumstances where the American
23 people suffer due to the inadequacy of the federal
24 government’s actions to protect the sovereignty of the
25 United States, all other public servants must speak
26 against such injustice and act decisively to rectify
27 this problem; NOW THEREFORE,
28 BE IT RESOLVED BY THE SENATE, That the Senate
29 supports increased protection for America’s borders
30 for the purpose of ending illegal immigration and

1 smuggling; and
2 BE IT FURTHER RESOLVED, That the Senate supports the
3 actions of Governor Abbott to safeguard the people of
4 Texas and endorses the decision of Governor Reynolds
5 to deploy Iowa National Guard and Iowa State Patrol
6 personnel to secure the Texas and national border; and
7 BE IT FURTHER RESOLVED, That the Senate encourages
8 the United States Congress to close the southern border
9 and reinstate funding for and construction of the
10 border wall; and
11 BE IT FURTHER RESOLVED, That the Senate condemns
12 President Biden’s executive actions relating to
13 the southern border and urges for the reinstatement
14 of federal Executive Order 13768 and Presidential
15 Proclamation 9844.
