A BILL FOR
1 An Act relating to the opioid settlement fund, including
2 appropriations of the moneys in the fund, and providing an
3 effective date.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 12.51, subsection 2, Code 2024, is
2 amended to read as follows:
3 2. a. Moneys in the fund shall not be transferred, used,
4 obligated, appropriated, or otherwise encumbered except as
5 provided in this section.
6 b. Annually, seventy-five percent of the moneys in the fund
7 shall be appropriated to the department of health and human
8 services and twenty-five percent of the moneys in the fund
9 shall be appropriated to the office of the attorney general.
10 The moneys appropriated shall be disbursed by the department
11 of health and human services and the office of the attorney
12 general in accordance with the requirements of any master
13 settlement agreement and this section. The moneys disbursed by
14 the department of health and human services or the office of
15 the attorney general shall be accompanied by a statement on any
16 printed or marketing materials that the funding is a one-time
17 allocation from the opioid settlement fund.
18 c. Moneys in the fund shall only be used pursuant to
19 appropriations from the fund by the general assembly for
20 purposes of abating the opioid crisis in this state, which
21 may include but are not limited to the purposes specified in
22 section 135.190A for moneys in the opioid antagonist medication
23 fund.
24 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate
25 importance, takes effect upon enactment.
26 EXPLANATION
27 The inclusion of this explanation does not constitute agreement with
28 the explanation’s substance by the members of the general assembly.
29 This bill relates to the appropriation of moneys in the
30 opioid settlement fund created in Code section 12.51.
31 The bill provides that annually, 75 percent of the moneys in
32 the fund shall be appropriated to the department of health and
33 human services (HHS) and 25 percent of the moneys in the fund
34 shall be appropriated to the office of the attorney general
35 (AG). Moneys appropriated to HHS or the AG shall be disbursed

1 in accordance with the requirements of any master settlement
2 agreement and the bill. Additionally, the moneys disbursed
3 by HHS or the AG shall be accompanied by a statement on any
4 printed or marketing materials that the funding is a one-time
5 allocation from the opioid settlement fund.
6 The bill takes effect upon enactment.
