1 An Act relating to the revocation or suspension of the
2 certification of a law enforcement officer.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 80B.13A, subsection 5, Code 2024, is
2 amended to read as follows:
3 5. Any All investigatory materials, including any
4 recommendation, notification, or other record or information
5 provided by an employing agency or the attorney general
6 pursuant to this section shall be confidential except as
7 required by rule or order of the council, an administrative law
8 judge, or a reviewing court. Any employing agency or person
9 who, acting reasonably and in good faith, files a notification
10 or recommendation, releases information, or otherwise
11 cooperates with an investigation under this section is immune
12 from any liability, civil or criminal, which might otherwise
13 be incurred or imposed for such action. If the investigative
14 information in the possession of the academy indicates a crime
15 has been committed, the information shall be reported to the
16 proper law enforcement agency. However, a final written
17 decision and finding of fact of the council in a disciplinary
18 proceeding or an informal stipulation and settlement agreement
19 are public records.
20 EXPLANATION
21 The inclusion of this explanation does not constitute agreement with
22 the explanation’s substance by the members of the general assembly.
23 This bill relates to the revocation or suspension of the
24 certification of a law enforcement officer.
25 The bill provides that all investigatory materials,
26 including any recommendation, notification, or other record or
27 information provided by an employing agency or the attorney
28 general shall be confidential except as required by rule
29 or order of the council, an administrative law judge, or a
30 reviewing court. If the investigative information in the
31 possession of the academy indicates a crime has been committed,
32 the information shall be reported to the proper law enforcement
33 agency.
34 The bill provides that a final written decision and finding
