1 An Act relating to deer hunting licenses issued as a result of
2 a deer-motor vehicle collision.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 483A.8D Deer-motor vehicle
2 collision license and tag.
3 1. As used in this section:
4 a. “Deer-motor vehicle collision” means an accident that
5 occurs on a roadway when a deer suddenly enters the path of a
6 motor vehicle and the motor vehicle strikes the deer.
7 b. “Roadway” means the same as defined in section 321.1.
8 2. Upon submission of a police report or an insurance
9 claim detailing a deer-motor vehicle collision in the state
10 and subsequent verification of the report by the department,
11 the department shall issue to a resident with a valid hunting
12 license involved in a deer-motor vehicle collision one free
13 antlerless deer only deer hunting license and tag to be used
14 by the resident in a current or upcoming hunting season, but
15 the license and tag shall expire fifteen months after issuance.
16 A resident using a license and tag issued pursuant to this
17 section may use any method of take authorized for the season
18 being hunted, subject to any other restrictions that may apply.
19 3. A resident who receives a free antlerless deer only
20 deer hunting license and tag under subsection 2 may transfer
21 the license and tag to a youth hunter. A resident may also
22 transfer the free antlerless deer only deer hunting license and
23 tag to the county recorder’s office of the resident’s county
24 for issuance and use in the county. The transferred licenses
25 and tags shall be issued at no cost to the county residents and
26 distributed at the discretion of the county recorder’s office.
27 4. This section shall not be construed to impose liability
28 on the state for damage to private property or bodily injury
29 resulting from a deer-motor vehicle collision.
30 EXPLANATION
31 The inclusion of this explanation does not constitute agreement with
32 the explanation’s substance by the members of the general assembly.
33 This bill relates to deer hunting licenses issued as a result
34 of a deer-motor vehicle collision.
35 Under the bill, a resident with a valid hunting license who

1 has been involved in a deer-motor vehicle collision may submit
2 a police report or insurance claim detailing the deer-motor
3 vehicle collision to the department of natural resources to
4 receive one free antlerless deer only deer hunting license
5 and tag to be used in a current or upcoming hunting season.
6 The license and tag shall expire 15 months after issuance. A
7 resident using a license and tag issued pursuant to the bill
8 may use any method of take authorized for the season being
9 hunted, subject to any other restrictions that may apply.
10 The bill authorizes a person who receives a free license and
11 tag under the bill to transfer the license and tag to a youth
12 hunter. A resident may also transfer the free license and tag
13 to the county recorder’s office for issuance and use in the
14 resident’s county. The transferred licenses and tags shall be
15 issued at the discretion of the recorder’s office and at no
16 cost to the county residents.
17 The bill shall not be construed to impose liability on the
18 state for damage to private property or bodily injury resulting
19 from a deer-motor vehicle collision.
