AN ACT
RELATING TO THE PROVISION OF EMERGENCY MEDICAL SERVICES BY A
PHYSICIAN AND SURGEON OR OSTEOPATHIC PHYSICIAN AND SURGEON
AND THE DEFINITION OF FIRST RESPONDER.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 135.190A, subsection 7, paragraph a,
2 Code 2024, is amended to read as follows:
3 a. “First responder” means an emergency medical care
4 provider, a registered nurse staffing an authorized service
5 program under section 147A.12, a physician assistant staffing
6 an authorized service program under section 147A.13, a
7 physician staffing an authorized service program under section
8 147A.13A, a fire fighter, or a peace officer as defined in
9 section 801.4 who is trained and authorized to administer an
10 opioid antagonist.
11 Sec. 2. Section 147A.1, subsection 7, Code 2024, is amended
12 to read as follows:
13 7. “First responder” means an emergency medical care
14 provider, a registered nurse staffing an authorized service
15 program under section 147A.12, a physician assistant staffing
16 an authorized service program under section 147A.13, a
17 physician staffing an authorized service program under section
18 147A.13A, a fire fighter, or a peace officer as defined in

19 section 801.4 who is trained and authorized to administer an
20 opioid antagonist.
21 Sec. 3. NEW SECTION. 147A.13A Physician exception.
22 This subchapter shall not restrict a physician from staffing
23 an authorized service program if the physician can document
24 equivalency through education and additional skills training
25 essential in the delivery of out-of-hospital emergency care.
26 The equivalency shall be accepted when:
27 1. Documentation has been reviewed and approved at the
28 local level by the medical director of the service program in
29 accordance with the rules of the board of medicine adopted
30 after consultation with the department.
31 2. Authorization has been granted to that service program
32 by the department.
33 Sec. 4. Section 233.1, subsection 2, paragraph g, Code 2024,
34 is amended to read as follows:
35 g. “First responder” means an emergency medical care
1 provider as defined in section 147A.1, a registered nurse
2 staffing an authorized service program under section 147A.12,
3 a physician assistant staffing an authorized service program
4 under section 147A.13, a physician staffing an authorized
5 service program under section 147A.13A, a fire fighter, or a
6 peace officer as defined in section 801.4.
