1 Section 1. 2016 Iowa Acts, chapter 1133, section 1,
2 subsection 1, as amended by 2017 Iowa Acts, chapter 173,
3 section 12, is amended to read as follows:
4 1. DEPARTMENT OF ADMINISTRATIVE SERVICES
5 For major maintenance projects:
6 FY 2016-2017:

8 However, of the moneys appropriated in this subsection,
9 $100,000 is Of the moneys appropriated in this subsection,
10 any unobligated and unencumbered moneys remaining as of the
11 effective date of this 2024 Iowa Act, are allocated for the
12 costs of major maintenance of monuments without dedicated
13 funds available for maintenance and restoration, subject to a
14 requirement that moneys shall not be allocated unless a match
15 of at least $2 for each $1 allocated is received from private
16 sources.
17 In addition, of the moneys appropriated in this subsection,
18 the department should give priority to projects that address
19 health and safety issues of Iowa law enforcement academy
20 facilities.
21 Sec. 2. 2016 Iowa Acts, chapter 1133, section 2, as amended
22 by 2019 Iowa Acts, chapter 137, section 7, is amended to read
23 as follows:
24 SEC. 2. REVERSION.
25 1. Except as provided in subsection 2, for purposes
26 of section 8.33, unless specifically provided otherwise,
27 unencumbered or unobligated moneys made from an appropriation
28 in this division of this Act shall not revert but shall remain
29 available for expenditure for the purposes designated until the
30 close of the fiscal year that ends three years after the end of
31 the fiscal year for which the appropriation is made. However,
32 if the project or projects for which such appropriation was
33 made are completed in an earlier fiscal year, unencumbered
34 or unobligated moneys shall revert at the close of that same
35 fiscal year.

1 2. For purposes of section 8.33, unless specifically
2 provided otherwise, unencumbered or unobligated moneys
3 appropriated and allocated for the costs of major maintenance
4 of monuments without dedicated funds available for maintenance
5 and restoration, in section 1, subsection 1, in this division
6 of this 2016 Iowa Act, shall not revert but shall remain
7 available for the purpose designated until the close of the
8 fiscal year that begins July 1, 2023.
9 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate
10 importance, takes effect upon enactment.
11 EXPLANATION
12 The inclusion of this explanation does not constitute agreement with
13 the explanation’s substance by the members of the general assembly.
14 Under current law, the department of administrative
15 services (DAS) controls a monument maintenance account in
16 the state treasury. The account includes moneys deposited
17 into the account for the maintenance of state monuments.
18 Any maintenance moneys in the fund for a state monument and
19 interest earned on the moneys must be used to maintain the
20 designated monument.
21 For FY 2016-2017, the general assembly allocated $100,000
22 from an appropriation to DAS for the costs of major maintenance
23 of monuments without dedicated funds available for maintenance
24 and restoration. However, the general assembly placed a
25 condition on the allocation restricting the receipt of moneys
26 unless DAS receives at least $2 from private sources for each
27 $1 allocated.
28 This bill strikes the private source funding requirement,
29 and provides that any moneys remaining from the original
30 appropriation are allocated for monument maintenance.
31 The bill strikes the provision under which the moneys will
32 revert at the end of FY 2023-2024.
33 The bill takes effect upon enactment.
