A BILL FOR
1 An Act relating to the personal needs allowance for residents
2 of certain facilities under the Medicaid program, and
3 providing an appropriation.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 249A.30A, Code 2024, is amended to read
2 as follows:
3 249A.30A Medical assistance —— personal needs allowance ——
4 appropriation.
5 The personal needs allowance under the medical assistance
6 program, which may be retained by a person who is a resident of
7 a nursing facility, an intermediate care facility for persons
8 with an intellectual disability, or an intermediate care
9 facility for persons with mental illness, as defined in section
10 135C.1, or a person who is a resident of a psychiatric medical
11 institution for children as defined in section 135H.1, shall
12 be fifty eighty-five dollars per month. A resident who has
13 income of less than fifty eighty-five dollars per month shall
14 receive a supplement from the state in the amount necessary to
15 receive a personal needs allowance of fifty eighty-five dollars
16 per month, if funding is specifically appropriated for this
17 purpose. The general assembly shall appropriate a sufficient
18 amount annually from the general fund of the state to the
19 department to provide the supplementation specified under this
20 section.
21 EXPLANATION
22 The inclusion of this explanation does not constitute agreement with
23 the explanation’s substance by the members of the general assembly.
24 This bill provides for an increase, from $50 to $85, in the
25 personal needs allowance under Medicaid retained by a person
26 who is a resident of a nursing facility, an intermediate care
27 facility for persons with an intellectual disability, or an
28 intermediate care facility for persons with mental illness, or
29 a person who is a resident of a psychiatric medical institution
30 for children. A resident who has income of less than $85 per
31 month shall receive a supplement from the state as necessary to
32 receive a personal needs allowance of $85. The bill provides
33 for an annual appropriation from the general fund of the state
34 to the department of health and human services an amount
35 sufficient to provide the supplementation specified in the
