A BILL FOR
1 An Act providing for standing appropriations for the annual
2 operations of state government, and including effective date
3 and applicability provisions.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 8.37 Annual appropriations for
2 operations of state government.
3 1. If, during a regular session of the general assembly, the
4 general assembly has not, on or before May 15, passed any Act
5 containing annual appropriations for the operations of state
6 government for the fiscal year beginning July 1 of the calendar
7 year in which the regular session occurs, all of the following
8 apply:
9 a. (1) For all line item appropriations, standing limited
10 appropriations, and standing unlimited appropriations otherwise
11 limited by law, including appropriations from federal and
12 nonstate funds, made for the prior fiscal year, the department
13 of management, in consultation with the legislative services
14 agency, shall determine the amount of the appropriations by
15 taking into consideration all of the following:
16 (a) All Iowa Acts appropriating moneys for the prior fiscal
17 year.
18 (b) All interdepartmental and intradepartmental transfers
19 made pursuant to section 8.39 and other provisions of law for
20 the prior fiscal year.
21 (c) Any other provisions of law affecting appropriations
22 for the prior fiscal year.
23 (2) The department of management, in consultation with the
24 legislative services agency, shall also identify the entities
25 to which such appropriations were made, or the entities’
26 successors.
27 b. There is appropriated from the appropriate state fund or
28 account to the entities identified pursuant to paragraph “a”,
29 subparagraph (2), for the fiscal year beginning July 1 of the
30 calendar year in which the regular session occurs, amounts, or
31 so much thereof as is necessary, equal to the amounts of the
32 appropriations made for the prior fiscal year, as determined
33 pursuant to paragraph “a”, subparagraph (1), each reduced by
34 one-half of one percent.
35 2. Appropriations made pursuant to subsection 1 shall not

1 include any of the following from the prior fiscal year, as
2 determined by the department of management, in consultation
3 with the legislative services agency:
4 a. Transfers of moneys.
5 b. Appropriations for capital or infrastructure projects
6 that do not require another appropriation.
7 c. Appropriations for pilot projects or other temporary
8 measures that do not require another appropriation.
9 3. If appropriations made from the general fund of the state
10 pursuant to subsection 1 would not comply with the general
11 fund expenditure limitation under section 8.54, the department
12 of management, in consultation with the legislative services
13 agency, shall further reduce appropriations made from the
14 general fund of the state pursuant to subsection 1, each by the
15 same percentage, such that appropriations made from the general
16 fund of the state pursuant to subsection 1 comply with the
17 general fund expenditure limitation under section 8.54.
18 4. For purposes of this section, “passed” means passed
19 in identical form by both houses of the general assembly,
20 regardless of whether the Act has yet been signed by the
21 speaker and president of their respective houses or presented
22 to the governor, as provided in Article III, sections 15 and
23 16, of the Constitution of the State of Iowa.
24 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate
25 importance, takes effect upon enactment.
26 Sec. 3. APPLICABILITY. This Act applies to fiscal years
27 beginning on or after July 1, 2024.
28 EXPLANATION
29 The inclusion of this explanation does not constitute agreement with
30 the explanation’s substance by the members of the general assembly.
31 If the general assembly has not, on or before May 15, passed
32 any Act containing annual appropriations for the operations
33 of state government for the upcoming fiscal year, this bill
34 appropriates moneys for the operations of state government for
35 that fiscal year based on the appropriations for the prior

1 fiscal year, reduced by 0.5 percent.
2 In order to accurately make the appropriations under the
3 bill, the bill requires the department of management, in
4 consultation with the legislative services agency, to identify
5 for the prior fiscal year (1) the amounts appropriated, (2)
6 the entities that received the appropriations, and (3) any
7 appropriations, such as those for infrastructure projects or
8 pilot projects, which would not require another appropriation.
9 If necessary, any general fund appropriations are further
10 reduced by an equal percentage in order to comply with the
11 state general fund expenditure limitation (Code section 8.54).
12 The bill takes effect upon enactment and applies to fiscal
13 years beginning on or after July 1, 2024.
