A BILL FOR
1 An Act prohibiting political subdivisions from purchasing or
2 acquiring certain fire fighting or fire-suppressing foam
3 containing perfluoroalkyl and polyfluoroalkyl substances.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 100B.51 Purchase or acquisition of
2 certain fire fighting foam by political subdivisions prohibited.
3 1. As used in this section, unless the context otherwise
4 requires:
5 a. “Perfluoroalkyl and polyfluoroalkyl substances” means a
6 class of fluorinated organic chemicals containing at least one
7 fully fluorinated carbon atom.
8 b. “Political subdivision” means a city, county, township,
9 or special purpose district. “Political subdivision” includes
10 a department, board, or commission of a city, county, township,
11 or special purpose district.
12 2. Beginning January 1, 2026, a political subdivision shall
13 not purchase or acquire a fire fighting or fire-suppressing
14 foam to which perfluoroalkyl and polyfluoroalkyl substances
15 have been intentionally added.
16 Sec. 2. IMPLEMENTATION OF ACT. Section 25B.2, subsection
17 3, shall not apply to this Act.
18 EXPLANATION
19 The inclusion of this explanation does not constitute agreement with
20 the explanation’s substance by the members of the general assembly.
21 This bill prohibits a political subdivision, as defined in
22 the bill, from purchasing or acquiring, on or after January
23 1, 2026, a fire fighting or fire-suppressing foam to which
24 perfluoroalkyl and polyfluoroalkyl substances have been
25 intentionally added.
26 The bill may include a state mandate as defined in Code
27 section 25B.3. The bill makes inapplicable Code section 25B.2,
28 subsection 3, which would relieve a political subdivision from
29 complying with a state mandate if funding for the cost of
30 the state mandate is not provided or specified. Therefore,
31 political subdivisions are required to comply with any state
32 mandate included in the bill.
