1 Section 1. DEPARTMENT OF HEALTH AND HUMAN SERVICES —— FLEX
2 CARE.
3 1. The department of health and human services is directed
4 to amend its administrative rules pursuant to chapter 17A to
5 provide that employees of a child care center who are sixteen
6 years of age or older may, without additional supervision,
7 provide flex care to children up to five years of age.
8 2. For purposes of this section:
9 a. “Child care” means the same as defined in section 237A.1.
10 b. “Child care center” means the same as defined in section
11 237A.1.
12 c. “Flex care” means child care provided during designated
13 nap hours and during brief periods when a child care center
14 employee who is eighteen years of age or older is not present
15 to provide supervision.
16 EXPLANATION
17 The inclusion of this explanation does not constitute agreement with
18 the explanation’s substance by the members of the general assembly.
19 This bill requires the department of health and human
20 services to amend its administrative rules to provide that
21 employees of a child care center who are 16 years of age or
22 older may, without additional supervision, provide flex care to
23 children up to five years of age.
24 “Child care” means the care, supervision, and guidance of
25 a child by a person other than the child’s parent, guardian,
26 or custodian for periods of less than 24 hours per day per
27 child on a regular basis, with certain exceptions. “Child care
28 center” means a facility providing child care or preschool
29 services for seven or more children, except when the facility
30 is registered as a child development home. “Flex care” means
31 child care provided during designated nap hours and during
32 brief periods when a child care center employee who is 18 years
33 of age or older is not present to provide supervision.
