1 An Act relating to open records requests.
2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 22.2, Code 2024, is amended by adding the
2 following new subsection:
3 NEW SUBSECTION. 3A. Whether for in-person examination and
4 copying of a public record under subsection 1 or electronic
5 examination and copying of a public record under subsection 3,
6 a government body may provide the requested public record or
7 the information contained in a public record in any reasonable
8 format. A government body is not required to provide the
9 public record or the information contained in a public record
10 in the format requested if a comparable alternative is provided
11 by the government body.
12 Sec. 2. NEW SECTION. 22.17 Public records accessible by
13 internet.
14 Notwithstanding any provision of this chapter to the
15 contrary, a government body is not required to provide a
16 copy of a public record that is published on the government
17 body’s internet site and is accessible to the public. The
18 government body shall notify the requester that the information
19 is available and direct the requester to the internet site
20 location where the public record can be found.
21 EXPLANATION
22 The inclusion of this explanation does not constitute agreement with
23 the explanation’s substance by the members of the general assembly.
24 This bill relates to open records requests. The bill
25 authorizes a government body to provide a requested public
26 record in a reasonable format. A government body is not
27 required to provide the public record in the format requested
28 if a comparable alternative is provided.
29 The bill also provides that if a public record is published
30 on a government body’s internet site, the government body does
31 not need to provide a copy of the public record but must notify
32 the requester of the public record’s internet site location.
