1 An Act relating to participation in school activities by
2 students enrolled in charter schools.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 256E.13 Students receiving
2 instruction over the internet —— participation in activities in
3 district of residence.
4 1. A student enrolled in a charter school who receives
5 educational instruction and course content primarily over the
6 internet may participate in any cocurricular or extracurricular
7 activities offered to children in the student’s grade or group
8 and sponsored by the district of residence under the same
9 conditions and requirements as the students enrolled in the
10 district of residence. The student may participate in not more
11 than two cocurricular or extracurricular activities during a
12 school year unless the resident district approves the student’s
13 participation in additional activities. The student shall
14 comply with the eligibility, conduct, and other requirements
15 relating to the activity that are established by the district
16 of residence for any student who applies to participate or who
17 is participating in the activity.
18 2. If a student participates in a cocurricular or
19 extracurricular activity in accordance with this section,
20 the district of residence may charge the charter school
21 up to two hundred dollars per activity, for up to two
22 activities. For a cocurricular activity, one semester shall
23 equal one activity. Extracurricular activities for which a
24 resident district may charge up to two hundred dollars per
25 activity for up to two activities under this section include
26 interscholastic athletics, music, drama, and any other activity
27 with a general fund expenditure exceeding five thousand
28 dollars annually. A student may participate in additional
29 extracurricular activities at the discretion of the resident
30 district. The resident district may charge the student a fee
31 for participation in such cocurricular or extracurricular
32 activities equivalent to the fee charged to and paid in the
33 same manner by other resident students.
34 Sec. 2. Section 280.13A, subsection 1, Code 2024, is amended
35 to read as follows:

1 1. If a school district, or nonpublic school, or charter
2 school operating under section 256E.5 does not provide an
3 interscholastic activity for its students, the board of
4 directors of that school district, or the authorities in
5 charge of the nonpublic school, or governing board of the
6 charter school may complete an agreement with another school
7 district, or nonpublic school, or charter school operating
8 under section 256E.5 to provide for the eligibility of its
9 students in interscholastic activities provided by that other
10 school district, or nonpublic school, or charter school. A
11 copy of each agreement completed under this section shall be
12 filed with the appropriate organization as organization is
13 defined in section 280.13 not later than April 30 of the school
14 year preceding the school year in which the agreement takes
15 effect, unless an exception is granted by the organization
16 for good cause. An agreement completed under this section
17 shall be deemed approved unless denied by the organization
18 within ten days after its receipt. The organization shall
19 determine whether an agreement would substantially prejudice
20 the interscholastic activities of other schools. An agreement
21 denied by the organization under this section may be appealed
22 to the state board of education under chapter 290.
23 EXPLANATION
24 The inclusion of this explanation does not constitute agreement with
25 the explanation’s substance by the members of the general assembly.
26 This bill authorizes a student enrolled in a charter school
27 under Code chapter 256E who receives educational instruction
28 and course content primarily over the internet to participate
29 in any cocurricular or extracurricular activities offered
30 to children in the student’s grade or group and sponsored
31 by the district of residence under the same conditions and
32 requirements as students enrolled in the district of residence.
33 The student shall comply with applicable eligibility,
34 conduct, and other requirements established by the district of
35 residence.

1 The bill authorizes the district of residence to charge
2 the charter school up to $200 per activity for up to two
3 cocurricular or extracurricular activities for a student
4 participating as provided in the bill. The resident district
5 may charge the student a fee for participation in such
6 cocurricular or extracurricular activities equivalent to the
7 fee charged to and paid in the same manner by other resident
8 students.
9 The bill authorizes a charter school operating under the
10 founding group-state board model to complete an agreement with
11 a school district, public school, or other charter school
12 operating under the founding-group-state board model providing
13 for student eligibility for interscholastic activities not
14 provided by the charter school but provided by the other
15 school. Existing procedures applicable to such agreements are
16 applicable to agreements authorized by the bill.
